CA Court: Parents have no right to homeschool their children
Two news articles came out today detailing the case of Philip and Mary Long and their fight with the state of California concerning the homeschooling of their children. The state contends that children must be instructed by someone who holds teaching credentials, while the parents exercised their natural rights to be in charge of their childrens education.
The case came out as the result of an investigation by the California Dept. of Children and family services (no surprise there), and ended up going before the 2nd district court of appeals. In that ruling, a judge said ” parents do not have a constitutional right to homeschool their children”
and
“A primary purpose of the educational system is to train school children in good citizenship, patriotism and loyalty to the state and the nation as a means of protecting the public welfare“
Loyalty to the state and the nation? That sounds just a little ominous IMO.
Now, my question is this: The judge stated there is no Constitutional right for parents to homeschool their children, perhaps he could enlighten us as to the Constitutional authorization given to the government to require children to attend any school?
I’m sure they would attempt to use the general welfare clause, but sadly that clause is one of the most overused, and abused sections of the Constitution, and many courts have twisted it to fit within their opinions.
Parents have a natural right to educate their children in any way they see fit, without having to be required to obtain any credentials put forth by the state.
Ya know who else banned homeschooling?
Adolf Hitler.

I couldn’t understand some parts of this article urt: Parents have no right to homeschool their children, but I guess I just need to check some more resources regarding this, because it sounds interesting.
Heard about this… allow me to ask this question? If we as parents can’t discipline our child the old fashioned way, How the hell am I to react when a failing school district not only doesn’t teach our children, but also doesn’t instill the morals one must have as an adult? Last I checked, my name was on the birth certificate! I don’t know about the rest of ya all, but I think Ruby Ridge sounds like a pretty good idea at this point!
Let the government brainwash (sorry, I meant teach) them and keep them stupid. Lowest education at the lowest possible price.
The government is out to kill us all. They don’t care about you. You are just a number to them. This is another example of the police state we live in.
Marianne, you rock, your statements on most topics are right on!!
GA. Thank you! After being put-down by SureFire….I’m glad someone appreciates my opinion.
